Terms of Service

These Terms of Service ("Terms") govern your access to and use of LeadPsi, including the website at leadpsi.com, the LeadPsi web application, and all related services (collectively, the "Service"). LeadPsi is operated by Bcreate Systems ("Bcreate", "we", "us").

By creating an account, signing in, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

  • You must be at least 18 years old and able to form a binding contract.
  • You are responsible for keeping your account credentials confidential and for all activity under your account.
  • Notify us promptly at support@leadpsi.com of any unauthorized use.

2. Subscription, Billing & Taxes

  • Subscription plans, prices, and feature limits are shown on our pricing page and may change with notice.
  • Prices are listed in Indian Rupees (INR). Applicable taxes (such as 18% GST) are added at checkout.
  • Monthly plans renew monthly; annual plans renew annually until cancelled.
  • Fees are non-refundable except where required by law or explicitly stated in a written agreement.
  • Failure to pay may result in suspension or termination of access.

3. Acceptable Use

You agree not to:

  • Use the Service to send spam, unsolicited messages, or content that violates applicable law (including India's telecom and data protection regulations).
  • Reverse engineer, decompile, or attempt to extract source code, except as expressly permitted.
  • Resell, sublicense, or white-label the Service without a written agreement (white-labelling is available on the Scale plan).
  • Use the Service to store or process unlawful, harmful, or infringing content.
  • Interfere with or disrupt the Service, attempt unauthorized access, or probe for vulnerabilities without our written permission.

4. Customer Data & Ownership

You retain all rights to the data you upload, import, or generate through the Service ("Customer Data"). You grant us a limited licence to host, process, transmit, display, and back up Customer Data only as needed to provide the Service. You are responsible for the lawfulness of Customer Data and for obtaining all required consents from your contacts.

5. Third-Party Integrations

The Service may interoperate with third-party services such as Meta (Facebook/Instagram) Lead Ads, Google Ads, WhatsApp Business API, and email providers. Your use of those services is subject to their own terms. We are not responsible for third-party services or outages.

When you connect third-party ad platforms (including Google Ads and Meta), you authorize LeadPsi to access those accounts on your behalf to provide the features described in our Privacy Policy. Your use of those platforms remains governed by Google's and Meta's own terms, and you are responsible for the accuracy and compliance of the ad accounts you connect.

6. Service Availability & Changes

We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. We will give reasonable notice of material changes that adversely affect paying customers.

7. Confidentiality

Each party will protect the other's non-public business information with the same care it uses for its own confidential information and will not disclose it except as needed to perform under these Terms or as required by law.

8. Intellectual Property

The Service, including all software, designs, trademarks, and documentation, is the property of Bcreate Systems and its licensors. Except for the limited rights expressly granted to you, no rights are transferred.

9. Termination

  • You may cancel at any time from your billing settings or by emailing support@leadpsi.com.
  • We may suspend or terminate accounts that breach these Terms, fail to pay, or pose a security risk.
  • On termination, your right to use the Service ends. You can export Customer Data for up to 30 days; after that we may delete it.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages. Bcreate's aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the fees you paid for the Service in the 12 months preceding the event giving rise to the claim.

12. Indemnity

You will defend and indemnify Bcreate Systems against third-party claims arising from your Customer Data, your use of the Service in violation of these Terms, or your violation of law.

13. Governing Law & Disputes

These Terms are governed by the laws of India. The exclusive jurisdiction for any dispute is the courts at Trivandrum, Kerala, India.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
